LIMITED WARRANTY: This limited warranty is extended only
to customers who purchase directly from C & M Products, Inc ( Stacks & Tracks ). (hereafter
referred to as C&M). All products distributed by C&M are warranted
to be free of defects in material and workmanship and meet manufacturers
specifications for a period of SIX MONTHS from the invoice date unless
otherwise specified.
OEM CPU's hold a 90-day functional warranty only. SOFTWARE, whether sold
in form or installed on hard-drives, does not carry warranty from C&M
except for simple replacement of defective distribution disks within 7
days. All software issues, warranties, compatibility, etc. are to be directed
to the software manufacturer.
SYSTEMS assembled by C&M are warranted for 1 year.
The warranty is invalid if:
1. The product is damaged by: accident, improper use, negligence, improper
installation procedure, improper power source, improper operating environment,
other customer's errors, or perils such as war, fire, theft, or vandalism
but not limited to.
2. Attempts have been made to repair or alter the product by anyone other
than those appointed by C&M.
3. The serial number and/or ID labels have been removed or tampered with.
Should the product prove to be defective in workmanship or material,
the customer's sole remedy shall be repair or replacement at the discretion
of C&M. Any further issues are between the end-user and manufacturer
of the components. Under no circumstances shall C&M be liable for
any loss or damage (direct, consequential, or incidental) arising out
of the inability to utilize the product. C&M will not be liable in
warranty or service for any issues with regard to software whether distributed
by C&M or another source. The customer agrees that all software issues
and warranties are to be exclusive responsibility of the software manufacturer
and hereby holds C & M Products, Inc. and its agents harmless from
any and all responsibility in that regard.
C&M makes no warranty other than the one set forth herein. Such warranty
is in lieu of all other warranties, expressed or implied, including, but
not limited to any expressed or implied warranty of merchantability or
fitness for a particular purpose, and such constitutes the only warranty
made with respect to goods.
Many products carry manufacturers' warranties that extend beyond C&M's
warranty.
MEMORY MODULES carry a lifetime manufacturers' warranty which the customer
may wish to pursue. Our representatives will make every effort to assist
with contact information for specific manufacturers.
RETURN MERCHANDISE POLICY AND PROCEDURE:
1. Obtain an RMA form from our website, www.stacksandtracks.com
2. Fill out the form in its entirety including invoice number, date, part,
serial number, and a detailed description of the reason for return. Products
not accompanied by a problem description will be tested on an "as
long as it works" basis, and the customer may be subject to diagnostic
fees (see below).
3. Fax or e-mail the completed RMA form along with a copy of the invoice
to the RMA department @ 301-868-1501. Details will be reviewed, and every
attempt will be made to respond with an RMA number faxed back within 24
hours. The RMA number is valid for 14 days.
4. Return the product, freight pre-paid, with a copy of the RMA form and
original invoice enclosed. The RMA number must be clearly visible on the
shipping label. Products returned without a legitimate RMA# will be rejected
at the customer's expense.
5. Returned products must be in their original boxes with all accessories
and documentation included. Any incomplete products will be replaced with
incomplete or refused at C&M's discretion. Final approval is contingent
upon receipt and inspection of the returned products by C&M.
WARRANTIES on replacement parts will continue from the date of the original
invoice.
C&M will repair, replace, or substitute with like or similar value,
the returned products at our own discretion when performing warranty service.
C&M will take no responsibility for any data left on hard drives
or data lost due to a product failure. The customer must complete backups
of data prior to the return of the products.
DOA PRODUCTS:
Products that are found to be defective within 7 days from the date of
purchase are considered Damaged On Arrival or DOA. DOA products may be
returned to C&M through RMA procedures, above, for immediate exchange
or replacement. All DOA products must be returned in their original packaging,
including manuals, cables, diskettes, etc. All DOA's will be tested before
replacement.
DIAGNOSTIC CHARGE:
If a product is sent to us as defective but found to be in good working
order, a minimum diagnostic charge of $35.00 will be applied. A defective
product sent to us without a problem description is also subject to the
same diagnostic charge.
DAMAGED PRODUCTS / SHIPMENT SHORTAGES:
All merchandise and packages are inspected before shipment and are insured
with the shipper. It is the buyer's responsibility to inspect packages
for damage or tampering before signing for their receipt from the carrier.
Should damage not be visible from the outside of the box, the buyer must
notify C&M immediately (within 48 hours) and buyer must retain the
product and packing material in the condition received for inspection
by the carrier. Otherwise, the product will be considered "damaged"
as listed above under "Limited Warranty", and the warranty will
be invalid.
Shortages, missing parts, or errors must be claimed within 48 hours of
the receipt of goods, otherwise the shipment is deemed to be complete.
Buyer shall give Seller further reasonable time to cure any mistakes.
SHIPPING OF RMA ITEMS:
Items being returned to C&M are the responsibility of the customer.
The customer must insure and accept the liability for loss or damage to
the products. Please take care to pack the items according to recommendations
of the shipper, and be sure that the RMA number is clearly marked on the
package. Any items deemed to be damaged from improper packaging or misuse
will not be warranted, and the items will be returned to the customer
freight collect (COD).
The customer must prepay shipping charges on all RMA shipments. A COD
shipment will be refused. Replacement products will be shipped after the
defective item is received and inspected by C&M return department.
RETURN POLICY:
All expendable items, software, and shipping charges, etc., are not returnable
or refundable.
Returns on all SPECIAL ORDERS and non-stock items may be subject to C&M's
ability to return the product to its supplier.
C&M reserves the rights to final decision to replace, repair, or
credit any product distributed by the company.
At C&M's sole discretion, products, exclusions indicated above, may
be returned for credit within 15 days of the date of the original invoice.
These returns are subject to a restocking fee of 15% or $15.00 whichever
is greater. Items must be returned in their original packaging with all
disks, manual and accessories. Customer should leave all manufacturers'
warranty cards blank until after 15 days.
After 15 days from the date of the original invoice, the merchandise
may only be replaced or repaired.
There will be no cash or check refunds on any returned merchandise. Credit
value will be applied to the customer's account.
ORDER CANCELLATION: A 15% restocking fee will be charged to the customer
for any system orders built by C&M and not purchased within 14 days
of completion.
OTHER SALES POLICIES, INTEREST CHARGES, AND FEES, etc.: C&M, at its
discretion may require reasonable advance assurances of payment, and or
guarantees. A $30 fee will be charged for checks returned for any reason.
Payments on credit terms are due the specified number of days after the
invoice date. A finance charge will be added to past due invoices at the
rate of 1.5% per month or fraction thereof which payment is delinquent.
In case of default of payment, C&M has the right, without notice
to the customer to declare all invoice amounts due and payable. If an
action is commenced to enforce payment as herein provided, the customer
agrees to pay collection agency fees, reasonable attorney(s) fees, court
costs, and other expenses incurred by C&M, and consents to the exercise
of jurisdiction over it by any local, county, state, or federal court
within the Commonwealth of Pennsylvania.
INDEMNIFICATION: Customer will indemnify, defend, and hold C&M from
any and all claims, damages, losses, costs and actions and expenses from
breach of customer's contractual agreement with any third party as the
result of buyer's purchase of merchandise from C&M.
WAIVER: No delay or omission by C&M to exercise any right or power
occurring upon any noncompliance or default with respect to any terms
of this agreement shall impair any such right or power, or be construed
as a waiver thereof. A waiver by C&M of any of the covenants, conditions,
or agreements to be performed by customers shall not be construed as a
waiver of any succeeding breach or default in the same or any other term
or condition hereof.
